Terms of Service
The agreement between you and DatumPilot for using the service.
These Terms of Service (“Terms”) govern your access to and use of DatumPilot, operated by IngeniVue Engineering Services Inc. By creating an account or using DatumPilot, you agree to these Terms. If you do not agree, do not use the service.
The service
DatumPilot helps engineers interpret an existing GD&T callout and recommend candidate feature control frames from design intent. The service provides decision-support information only. It does not provide certified engineering, inspection, or compliance decisions, and it is not a substitute for review by a qualified engineer.
Accounts
You are responsible for your account credentials and for activity under your account. You must provide accurate information and keep it current. You must be at least 16 years old (or the age of majority in your jurisdiction, if higher) and able to form a binding contract to use the service.
Acceptable use
Your use of DatumPilot is subject to our Acceptable Use Policy, which is incorporated into these Terms.
Subscriptions and billing
Paid plans are sold as recurring subscriptions billed through Stripe on a monthly or yearly interval. By subscribing, you authorize recurring charges until you cancel. Cancellation, renewal, and refund handling are described in our Refund and Cancellation Policy. If you are a consumer in the EU/EEA or UK, that policy also explains your statutory right of withdrawal and how it works when you ask us to start the service immediately.
Intellectual property
DatumPilot, including its software, design, and content, is owned by IngeniVue Engineering Services Inc. and its licensors. You retain rights in the inputs you provide. You grant us the limited rights needed to process your inputs and operate the service as described in our Privacy Policy.
Disclaimers
- DatumPilot outputs are provided “as is” for informational and decision-support purposes only.
- Outputs may be incomplete or incorrect. You are responsible for independently verifying any result before relying on it.
- DatumPilot does not warrant that the service will be uninterrupted, error-free, or fit for any particular certified engineering purpose.
- Using DatumPilot does not constitute the practice of professional engineering and creates no engineer–client relationship between you and IngeniVue Engineering Services Inc. Verify outputs against the applicable standard (for example ASME Y14.5 or ISO GPS) and review by a qualified, accountable engineer.
Limitation of liability
To the maximum extent permitted by law, IngeniVue Engineering Services Inc. is not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on the service. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the service is limited to the greater of (a) the fees you paid us for the service in the 12 months before the event giving rise to the claim, or (b) USD 100.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including the mandatory rights you have under the consumer-protection laws of your jurisdiction.
Termination
You may stop using DatumPilot at any time. We may suspend or terminate access if you breach these Terms or the Acceptable Use Policy, or where required for security or legal reasons.
Changes to these Terms
We may update these Terms as the service evolves. We will update the “Last updated” date and, where appropriate, provide additional notice. Continued use after changes take effect means you accept the updated Terms.
General terms
- Entire agreement: These Terms, together with the Acceptable Use Policy and Privacy Policy, are the entire agreement between you and IngeniVue Engineering Services Inc. about the service.
- Severability: If any provision is found unenforceable, the remaining provisions stay in effect.
- Assignment: You may not assign these Terms without our consent; we may assign them to an affiliate or successor.
- Force majeure: Neither party is liable for delays or failures caused by events beyond its reasonable control.
- Notices: We may give notice through the service or by email to the address on your account.
Governing law and contact
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have non-exclusive jurisdiction over any dispute. If you are a consumer, this does not deprive you of the mandatory protections of the consumer-protection laws of the country where you live.
